Terms of Service

1. Agreement to Terms

By accessing or using QualityOS (“https://qcrelease.com”), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users, including organizations on a free trial and paid subscription.

2. Description of Service

QualityOS is a cloud-based quality management system (QMS) for regulated manufacturers. Features include lot tracking, lab result management, certificate of analysis (COA) storage, and out-of-specification (OOS) investigation workflows. We reserve the right to modify or discontinue features with reasonable notice.

3. Accounts and Access

You must provide accurate registration information. You are responsible for all activity under your account. Notify us immediately at legal@qcrelease.com if you suspect unauthorized access.

Each organization account may have one or more users as determined by your subscription plan. You may not share login credentials between users.

4. Free Trial

New accounts receive a 14-day free trial. No credit card is required during the trial. At the end of the trial, your account will be restricted until you subscribe to a paid plan. Trial data is retained for 30 days after trial expiration, then permanently deleted if no subscription is activated.

5. Subscriptions and Billing

Paid plans are billed monthly or annually in advance via Stripe. All fees are non-refundable except as required by law or as stated in our refund policy. Prices are subject to change with 30 days written notice.

If payment fails, your account will enter a grace period of 7 days before access is restricted. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period.

6. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of applicable regulations
  • Upload malicious code, viruses, or content that infringes third-party rights
  • Attempt to reverse-engineer, decompile, or bypass security controls
  • Resell or sublicense access to the service without written consent
  • Use the service to store data unrelated to quality management operations

7. Your Data

You retain ownership of all data you upload to QualityOS. By uploading data, you grant us a limited license to store, process, and display it solely to provide the service.

You are responsible for ensuring that any data you upload complies with applicable regulations, including 21 CFR Part 11 obligations specific to your facility. QualityOS provides tools to support compliance but does not guarantee regulatory compliance on your behalf.

8. Data Security

We use industry-standard security practices including row-level security, encryption in transit (TLS), and encrypted storage. We do not sell or share your data with third parties except as necessary to provide the service (e.g., cloud infrastructure providers). See our Privacy Policy for details.

9. Uptime and Support

We target 99.9% monthly uptime but do not guarantee it. Scheduled maintenance will be communicated in advance. Support is provided via email at legal@qcrelease.com with a target response time of 1 business day for paid plans.

10. Intellectual Property

QualityOS and its software, design, and content are owned by us and protected by copyright and other intellectual property laws. These terms do not grant you any rights in our intellectual property other than the limited right to use the service as described.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUALITYOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Termination

We may suspend or terminate your account for material breach of these terms with reasonable notice, or immediately for violations of Section 6 (Acceptable Use). Upon termination, your data will be deleted within 30 days. You may export your data at any time while your account is active.

14. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction in the United States.

15. Changes to These Terms

We may update these terms with 30 days notice via email or in-app notification. Continued use after the effective date constitutes acceptance of the updated terms.
